Definitions

Buyer: refers to the person who makes a purchase transaction from the Memoria online Boutique page at www.memoria.ca.

Memoria: refers to Les Espaces Memoria Inc. (also known as Alfred Dallaire/MEMORIA)

Memoria online Boutique: refers to the products available for order on the Internet from the www.memoria.ca ("Website")


Acceptance of Terms of Use

By using the Memoria Online Store, you acknowledge that you have read and understood the terms and conditions described on this page. You also acknowledge that you have read and understood the general terms and conditions of use of the Internet Site, which also apply to the Memoria online Boutique. If you do not wish to be bound by all of these terms and conditions of use, you may not use the Memoria online Boutique and order products through this page of the Internet Site.


Reserve

Memoria reserves the right to modify this policy at any time and without prior notice.

Method of payment

Only valid Visa and MasterCard credit cards are accepted.


Prices

All prices displayed in the Memoria online Boutique are in Canadian dollars. Handling and delivery fees for flowers within the Montreal metropolitan area and within a 40 km radius of the Island of Montreal are included in these prices. For all other products sold on the Website, handling and delivery charges are extra. Memoria reserves the right to modify prices at any time.

Applicable sales taxes are extra.

Prices for products offered in the Memoria online Boutique may differ from prices for the same products displayed in Memoria branches and complexes.


Terms of sale

Once you have made your online purchase, you will receive an e-mail confirming your order. Please keep this e-mail as a receipt for the products ordered. If you have not received a confirmation e-mail within four (4) hours of placing your order, please contact us without fail at info@memoria.ca or by telephone at 514-277-7778 or toll-free at 1-(866) 277-7778.


Product availability

Memoria makes every reasonable effort to ensure that the products offered in the Memoria online store are available. However, Memoria in no way guarantees the availability of the products offered in the Memoria online Boutique. If any of the products ordered cannot be delivered, Memoria will notify the Purchaser of this fact by e-mail or telephone, offering the following options:

  • Maintain the order and replace the chosen product with an equivalent product at the same price as the one ordered;
  • Offer the Buyer a replacement product. In this case, if the Buyer accepts a replacement product at a lower price than the product ordered, the difference will be refunded to the credit card used for the initial order. If the Purchaser chooses a replacement product at a higher price than the product ordered, the difference will be charged, with the Purchaser's agreement, to the same credit card used for the initial order; or
  • Cancel the order. In this case, the total price of the product chosen in the initial order will be refunded to the credit card used for that order.
In the case of flower orders, the products delivered may differ from those ordered and shown in the photos in the Memoria online store, in particular depending on the availability of flowers in the store at the time of a given order. In such a case, an equivalent floral product will be used. Our partner florists will make every effort to preserve the spirit of the bouquet suggested on a given photo in the Memoria online Boutique. However, it remains at the florist's discretion to decide whether or not it is necessary to call the customer back to change certain flowers, depending on the extent of the changes to be made to the given order.

Memoria cannot be held responsible for any damage suffered as a result of an inventory shortage at a partner florist.


Product delivery

Memoria will deliver the products ordered in any purchase transaction under the following conditions:
  • In the case of flowers, provided the order has been received by Memoria within 48 hours of the start of a given exhibition or other event, they will be delivered directly to the funeral home (branch or complex) where the exhibition or event is taking place.
  • In the case of condolence cards, if the order is received by Memoria within 48 hours of the start of a viewing or other funeral activity, they will be delivered directly to the funeral home concerned (branch or complex). After this time, or if there is no viewing or ceremony at the funeral home (branch or complex), the condolence card will be mailed directly to the person designated by the Purchaser.
  • In the case of other types of goods or products, the Purchaser may choose at the time of ordering between (i) picking up the product at one of Memoria's branches upon presentation by the Purchaser of proof of purchase for this product, or (ii) postal delivery. In the latter case, delivery will be made to the postal address provided by the Purchaser at the time of ordering. No delivery will be made to a post office box.
  • Memoria shall have received full payment for any product ordered before it is delivered to the Purchaser, whether at one of Memoria's branches or by postal delivery.

Return policy

If the product delivered does not conform to the product ordered by the Purchaser, Memoria undertakes to correct the error and replace the product free of charge and as soon as possible, provided that the product has been returned by the Purchaser to one of Memoria's complexes or branches within 48 hours of delivery of the product and upon presentation by the Purchaser of proof of purchase of the product.


Refund policy

Memoria's refund policy is to replace the product if it does not conform to the one ordered, according to the terms described in the previous paragraph.

On the other hand, Memoria may make a refund to the Purchaser only in the following cases:
  • If proof satisfactory to Memoria is provided that delivery has not been made for any reason whatsoever, unless an error has been made by the Purchaser;
or
  • if the Purchaser chooses to cancel his/her order due to the unavailability of the product chosen during the purchase transaction, as provided for in the "product availability" section above.

Security & Privacy

We maintain the confidentiality of personal information and take all reasonable precautions to prevent its loss, misuse or alteration.

Memoria stores all the personal information you provide on secure servers.

Information related to electronic payments made on its Web Site is transmitted directly to the payment gateway and is not stored on Memoria's servers. Memoria does not store any credit card information on its servers.

This Privacy Policy applies only to activities related to the use of the Memoria Online Store. Any other Internet site accessible from the Memoria online store (as well as any third-party Internet site with which Memoria associates itself) has its own usage policies over which Memoria exercises no control. Memoria declines all responsibility for the policies and practices of these Internet sites, particularly with regard to confidentiality.

You acknowledge that acceptance of this Privacy Policy and its periodic updates is a condition precedent to your use of the Memoria Online Store and you agree to be bound by all of its terms and conditions.
